A fresh Delhi High Court judgment dated 7 September 2026 has dealt with exactly this issue.
In Poonam v. State NCT of Delhi, MAT.APP.(F.C.) 285/2026, the parties married on 18 January 2019 at Gurugram.
After marriage, they lived together at Sangam Vihar, Delhi, for around 1½ to 2 years.
Then the husband obtained employment in Gurugram, and the couple shifted to rented accommodation there.
According to the wife's pleadings, they continued living together in Gurugram for more than four years before they separated.
The wife subsequently filed a divorce petition before the Family Court at Saket, Delhi, relying, among other things, on their earlier residence in Sangam Vihar.
But the Family Court returned the petition under Order VII Rule 10 CPC, holding that Delhi lacked territorial jurisdiction because the parties had last resided together in Gurugram.
The matter then reached the Delhi High Court.
And this is where the case becomes interesting for anyone dealing with a Delhi matrimonial case.
The High Court examined Section 19 of the Hindu Marriage Act, 1955, including the provision concerning the place where the parties last resided together.
The Court noted that although the couple had lived in Sangam Vihar for about two years, they subsequently lived together in Gurugram for more than four years.
Therefore, the earlier Delhi residence could not by itself confer territorial jurisdiction on the Delhi Family Court.
The High Court held that Gurugram was the place where the parties last resided together, and dismissed the appeal on maintainability as well as merits.
Marriage
Parties
For a Delhi/NCR husband, particularly where the family has moved between Delhi, Gurugram, Noida, Faridabad or another NCR city, old rent agreements, address proofs, employment records, school records and other residence documents can suddenly become important.
And that is why Delhi matrimonial litigation

Case-specific caution: This judgment turned on the particular residence chronology pleaded before the Court — including the couple's earlier stay in Sangam Vihar and their subsequent longer period of joint residence in Gurugram. It does not mean that every matrimonial petition involving Delhi and another NCR city will lack Delhi jurisdiction; the applicable clause of Section 19 HMA and the actual facts and evidence of each case have to be examined separately.
